Section 144 imposed by District Magistrate, Cachar

October 31: In the backdrop of the road accident which occured at Meherpur on 30 October, 2019 and subsequent apprehension of the breach of peace and tranquility, Laya Madduri in the capacity of District Magistrate (DM) has clamped Section 144 of CrPC in Cachar. In an order issued by the DM in the afternoon of 31 October, 2019, it was stated that, “this order shall come into force with immediate effect and shall remain in force until further order.” It was also stated that anyone violating it, will be punished under various provisions of the IPC.

Section 144 of the Criminal Procedure Code (CrPC) of 1973 authorises the Executive Magistrate of any state or territory to issue an order to prohibit the assembly of five or more people in a group in an area. According to the law, every member of such ‘unlawful assembly’ can be booked for engaging in rioting. Section 144 is imposed in urgent cases of nuisance or apprehended danger of some event that has the potential to cause trouble or damage to human life or property. Section 144 of CrPC generally prohibits public gathering.
