Gauhati High Court dismisses 6 years old case against Subramanian Swamy filed in Karimganj
Dec. 9: The Gauhati High Court on Thursday quashed all orders of lower courts in relation to an alleged hate speech case registered against Dr Subramanian Swamy in 2015 (Dr Subramanian Swamy v. State of Assam). An allegation was brought against Dr Subramanian Swamy in Karimganj Court in 2015. A lawyer filed the complaint, and the Karimganj court issued a warrant for Swamy’s arrest. Swamy has filed a writ petition with the number WP(C) 4186/2015 challenging the subject.
The complaint against Swamy was filed before the Chief Judicial Magistrate at Karimganj on March 17, 2015. In the written complaint, it was stated that the accused was a influential leader of the Bharatiya Janata Party (BJP), and religiously intolerant. It was alleged that on March 14 that year, Dr Swamy, while interacting with the press, made some “derogatory, unconstitutional and provocative” remarks against Islam which was published in different media. The complaint was rejected by Justice Manish Choudhury’s court.
Taking to his twitter handle on 9 December, Subramanian Swamy wrote, “Assam HC today dismissed a Hate Speech case filed against me in Karimganj Court. It is a devastating order against those who filed it and got a warrant issued. Satya Sabharwal assisted me prepare my Defence. Others too helped. I shall name them next tweet. VHS Tony was great.”

Dr Swamy, appearing before the High Court in person, essentially challenged the criminal prosecution launched against him in its entirety. The Court accordingly set aside and quashed all criminal proceedings in the matter, and merged today’s order with its earlier one staying the proceedings.
