Over 1000 cases in courts for 50 years & above 2 lakh cases pending for 25-years: Ranjan Gogoi
দুই লক্ষের বেশি মামলা ২৫ বছর ধরে চলছেঃ গগৈ
দেশের প্রধান বিচারপতি রঞ্জন গগৈ রবিবার গৌহাটি হাইকোর্টের অডিটোরিয়াম নির্মাণের শিলান্যাস করেন। সেখানেই বলেন, হাইকোর্টের মুখ্য বিচারপতিদের ২৫ বছরের পুরনো মামলাগুলি দ্রুত নিষ্পত্তি করতে নির্দেশ দিয়েছেন।
তাঁর কথায়, দেশের বিভিন্ন আদালতে এই সময়ে ৯০ লক্ষ দায়রা (সিভিল) মামলা রয়েছে। এর মধ্যে ২০ লক্ষই সমন জারির প্রক্রিয়ায়। অর্থাত ২৩ শতাংশ মামলায় বলতে গেলে হাতই দেওয়া হয়নি। ফৌজদারি মামলায় এই হার আরও বেশি। তিনি জানান, আড়াই কোটি ফৌজদারি মামলার মধ্যে এক কোটির উপরে সমন পৌঁছানোর অপেক্ষায়। সমন না পৌঁছালে আদালত কিছু করতে পারে না বলে মন্তব্য করেন প্রধান বিচারপতি। তিনি মামলা নিষ্পত্তিতে বিলম্বের জন্য বিচারপতিদের শূন্যপদকেও কারণ বলে উল্লেখ করেন। গগৈ জানান, দেশের হাইকোর্টগুলিতে ১ হাজার ৭৯টি বিচারকের পদের মধ্যে ৪০৩টি এই সময়ে শূন্য পড়ে রয়েছে। তিনি জানান, অসমে অবশ্য ৫০ বছরের পুরনো মামলা নেই। ২৫ বছরের পুরনো মামলা ১০৬টি।
August 4: In a startling revelation, Chief Justice of India (CJI), Ranjan Gogoi said on Sunday that more than two lakh cases are in courts for 25 years, while over 1,000 cases have not been disposed of even after 50 long years. Gogoi was speaking during the foundation stone laying ceremony of the auditorium of the Gauhati High Court, Guwahati, on 4 August, 2019.
The CJI also said, out of about 90 lakh pending civil cases, more than 20 lakh are at a stage where summons have not been served yet. He said he had addressed the chief justices of various high courts on July 10, during which he requested them, inter alia, to “go after” the 50-year-old and the 25-year-old cases.In Assam and other northeast states, there is no case which are pending for 25 years, Gogoi said.
In criminal cases, the figure is worse. Out of 2.10 crore (pending) criminal cases, the total pendency at the summoning stage is over a crore.If summons have not been served, how do my judges start the trial? This is my question to the executive. The responsibility of summoning solely lies with the executive arm of the government,” the CJI said.
Gogoi further expressed hope that the Centre will accept his proposal to raise the retirement age of high court judges to 65 years from the current 62.
