Ahead of Assembly Election, Section 144 CrPC clamped in Cachar

March 25: In view of Assembly Election, 2021 to all 7 constituencies of Cachar District on 1 April, 2021, the District Magistrate Cachar has issued a number of prohibitions under Section 144 of the Indian Penal Code for speedy remedy and immediate prevention of disturbances of peace and tranquility in the conduct of election process.

Issuing an order to this effect on Wednesday, District Magistrate Cachar Keerthi Jalli IAS stated that different political parties and contesting candidates may set up booths within 200 meters from the concerned polling stations, which is against the standing instruction of Election commission of India. In apprehension of some anti-social elements which may or are likely to intimidate the voters before the poll day and on poll day by using two wheelers, like bikes etc.

The District Magistrate , Cachar Keerthi jalli IAS has imposed Section under 144 Cr Pc in entire Cachar District,under which no booth shall be set up within a distance of 200meters from any polling station.,each candidate wishing to set up booth beyond 200meters from the polling station shall intimate in writing in advance to the returning officer ,the names and serial number of the polling stations where such where such booths are proposed to be set up. He or she shall obtain the written permission of the concerned government authorities.

Only one banner to display the name of the candidate and election symbol allotted to the candidate, provided such banner should not be more than 3 feet by 4.5 feet in length and breadth. Any banner, poster, flag, symbol or any other propaganda material set up in violation of this restriction will be removed by authorities maintaining the law and order. Bike rallies shall not be allowed at any place 72 hours before date of poll and on poll day in all poll going constituencies.

It further stated that no crowd shall be allowed to gather at such booths under any circumstances and no person will be allowed to come to the booth once he casts his vote. The persons manning the booths shall not cause any obstruction whatsoever in the way of electors proceeding to the polling stations or prevent them from going to the booths of other candidates or create any other sort of hurdle whatsoever in the right of voters to exercise their franchise according to their own free will.

Any violation of rules will be viewed with utmost gravity and stringent action under the law including removal of such booths forthwith will be taken against the candidate.
