প্রধান বিচারপতি রঞ্জন গগৈর বিরুদ্ধে যৌন নিগ্রহের অভিযোগ দায়ের করে এ বার নিজেই তদন্ত প্রক্রিয়া থেকে সরে থাকতে চান অভিযোগকারিণী। তিন বিচারপতির ইন হাউস কমিটির ওপর আস্থা নেই বলেই তাঁর এই সিদ্ধান্ত বলে জানিয়েছেন তিনি।

রঞ্জন গগৈয়ের বিরুদ্ধে ওঠা অভিযোগ খতিয়ে দেখতে তিন বিচারপতি এসএ বোবদে, ইন্দু মলহোত্র এবং ইন্দিরা বন্দ্যোপাধ্যায়কে নিয়ে বিশেষ ইন হাউস কমিটি গড়া হয়েছে। অভিযোগকারিণী সুপ্রিম কোর্টের প্রাক্তন কর্মী সংবাদমাধ্যমকে জানান, অভিযোগ জানাতে এত দেরি হল কেন, ইন হাউস কমিটি বারবার একই প্রশ্ন করে চলেছে। সুপ্রিম কোর্টের তিন বিচারপতি লাগাতার জেরা করে চলেছেন। তার উপর হাজিরা দেওয়ার সময় আইনজীবী বা সঙ্গে কাউকে  নিয়ে যাওয়ার অনুমতি নেই। এমনকি বয়ানের ভিডিয়ো বা অডিয়ো রেকর্ডিংও করা হয় না।

তাঁর কানে শোনার সমস্যার কথা উল্লেখ করে তিনি বলেন, রুদ্ধদ্বার আদালতে  আমার বয়ান হিসাবে যা তুলে ধরা হয়, তা বুঝতেও অসুবিধা হয় আমার।  গত ২৬ এবং ২৯ এপ্রিল যে বয়ান রেকর্ড করেছিলাম, তার কোনও কপিও আমাকে দেওয়া হয়নি।

তাঁর কথায়, ‘‘তদন্ত প্রক্রিয়া কোন পথে এগোচ্ছে, সে  ব্যাপারে কিছুই জানানো হয়নি আমাকে। তাই ন্যায্য বিচার পাওয়ার কোনও আশাই নেই। ফলে তদন্ত থেকে সরে দাঁড়ানোর সিদ্ধান্ত নিয়েছি।’’ এ দিনও ওই কমিটির সামনে হাজিরা দেন তিনি। সেখানে অভিযোগ জানাতে দেরি হওয়ার কারণ জানিয়ে একটি চিঠি জমা দিয়েছেন বলে জানান অভিযোগকারিণী ওই মহিলা।

গত ১৯ এপ্রিল সুপ্রিম কোর্টের ২২ জন বিচারপতিকে হলফনামা দিয়ে প্রধান বিচারপতি রঞ্জন গগৈয়ের বিরুদ্ধে যৌন নিগ্রহের অভিযোগ জানান ওই মহিলা। তিনি জানান, জুনিয়র কোর্ট অ্যাসিস্ট্যান্ট হিসাবে সুপ্রিম কোর্টে কর্মরত ছিলেন তিনি। সেই সময় ২০১৮ সালের অগস্ট মাসে প্রধান বিচারপতির বাড়ির অফিসে কাজ করার দায়িত্ব পান। সেখানে তাঁকে যৌন হেনস্থা করেন প্রধান বিচারপতি। প্রতিবাদ করলে চাকরি থেকেই বরখাস্ত করা হয়। প্রধান বিচারপতি যদিও শুরু থেকেই অভিযোগ অস্বীকার করে আসছেন।

April 30: The former Supreme Court staff who accused Chief Justice Ranjan Gogoi of sexual harassment today said she was boycotting the “in-house proceedings” due to “serious concerns and reservations”. Her withdrawal came after the panel, led by Justice SA Bobde, held its third in-chamber sitting on Monday. In the three hearings held so far, the woman said she felt intimidated as she has to appear alone and even her lawyer was not allowed to be a part of the proceedings.

In a press release she said, “I felt I was not likely to get justice from this committee and so I am no longer participating in the 3 Judge Committee proceedings”. She also pointed out that there was no video or audio recording of the committee proceedings, she was not supplied even a copy of her statements during the first two sittings on April 26 and 29 and she was not even informed about the procedure the committee was following.

The panel comprises Justices SA Bobde, Indu Malhotra and Indira Banerjee. The complainant – a former employee of the top court – had made the allegations against the Chief Justice in an affidavit sent to several judges last week. She had worked at Justice Gogoi’s home office in Delhi and the allegations were carried by the news portals based on her affidavit which was sent to 22 judges of the top court.
