Ahead of fresh poll, Section 144 CrPC clamped at the polling centre in Sonai

April 18: The Election Commission of India on April 10 declared the votes polled at the Booth No. 109 of Madhya Dhanehari LP School No. 463 in Sonai Assembly constituency as void and ordered for fresh poll at the station. Re-poll in that polling station will be held on 20 April, 2021. It is in this connection that Scetion 144 of CrPC was promulgated in the area by the District Magistrate of Cachar.

Keeping this in view District Magistrate Cachar has issued a number of prohibitions under Section 144 of the Indian Penal Code at the polling station 109,463 Madhya Dhanehari L.P School under Sonai Constituency for speedy remedy and immediate prevention of disturbances of peace and tranquility in the conduct of election process.

Further, to maintain peace, public tranquillity and safety of the public in general and the voters in particular on the day of repoll, DM Jalli in her order mentioned that no person is/are allowed to carry/ use any bomb/ crackers or any other materials, which can produce sound or any chemical effect. Moreover, no person/ group of people is/are allowed to carry toy gun/ toy pistol and revolver with immediate effect. It was also specified that no booth shall be set up within a distance of 200 meters from Polling Station No. 109 (463 No. Madhya Dhanehari L.P. School) under LA 10 Sonai Constituency.

According to which no person or group are allowed to carry any weapon like lathi,lance,spears,dao or any other articles which can be used as weapon of offence with immediate effect. No person or group are allowed to carry any bomb,crackers or any other materials which can produce sound or any chemical effects with immediate effect. No person or group are allowed to carry any toy gun,toy pistol or revolver with immediate effect.

Movements of individual ,group ,organisation,club, society members are prohibited within 1 km radius of polling station 109,463 Madhya Dhanehari L.P School where his,her or their names don’t figure out in the voters list either on foot,two wheelers,three wheelers or four wheelers on the day of polling. No person is allowed to use any apparatus which is capable of producing sound or reproducing human voice like tape recorders etc on the day of polling. No booth can be set up within a distance 200 meters from polling station 109,463 Madhya Dhanehari L.P School under Sonai Constituency.

Each candidate wishing to set up any booth beyond 200 meters from the polling station should intimate in writing in advance to the returning officer,the name and serial number of the polling stations where such booths are proposed to be set up by him or her. He or she shall obtain the written permission of the concerned government authorities or local bodies under the relevant local laws before setting up such booth. Such a written permission must be available with the persons Manning the booth for production before police , election authorities on demand.

Only one banner to display the names of the candidate,his or her party and the election symbol allotted to him or her shall be allowed to each such booth provided that such banner shall not be more than 3 feet by 4.5 feet in length and breadth. Any banner,poster ,flag, symbol or any other propaganda set up in violation of this restriction will be removed by the authorities maintaining the law and order. Vehicular movement will be restricted from 200 meters of the polling station to prevent any choke points.
