TDC non-CBCS students file writ petition in HC on ‘Assam University’s silence’ about their exam
July 6: A writ petition was filed in Gauhati High Court by 100 students of TDC Non-CBCS course of study under Assam University, Silchar (AUS) for not conducting their odd and even semester examinations. The writ petition No. WP(C)/ 5601/2021 was filed in the High Court on 1 July, 2021. Filing the writ on behalf of the students, Advocate Gautam Choudhury stated that the writ was filed in the matter of, “Inaction of the Vice-Chancellor and/or The Controller of Examinations, and other concerned Authorities on the multiple representations made by the aggrieved Non-CBCS students, thereby further aggravating the future of the students and also affecting their
careers etc due to such non considerations.”
The petition by the aggrieved students stated, “This Writ Petition has been laid before this Honble Court for bringing to light the arbitrary and discriminating actions of the Authorities of Assam University, Silchar affecting future prospects and careers of a huge chunk of Three years Degree Course (TDC) students by denying and ignoring their repeated demands of conducting online examinations or any alternate method of examination which will consider the conditions of the current pandemic.”
“That the Authorities of Assam University discriminated against the Non-CBCS (not falling under Choice Based Credit System) students by denying them the option of appearing for online examination however allowing the students for the same who fall under the CBCS category. Moreover, the authority has also ignored a number of representations made by the aggrieved students and has taken no immediate steps to address the issues raised by the students,” added the petitioners.
Speaking to way2barak, one of the petitioners stated that, “This issue is of utmost importance as the actions of the University has caused uncertainty as to the future prospects of the students and jeopardised our career. The plight of all the Non-CBCS students is at stake as they are going to lose an academic year because of the fault of the University. Therefore, we have sought the intervention of the High Court in order to meet the ends of justice and to pass any order as the Court may deem fit and proper in the facts and circumstances of the case.”
The student further alleged that have submitted approximately more than 25 memorandums to various authorities including the Deputy Commissioner, Cachar, Principal of Colleges, Vice Chancellor or Assam University, Silchar, Controller of Examinations of AUS. However, the student stated, “We are running from one door to the other, the Principal of Colleges ask us to approach the university, whereas the university authorities sends us back to the colleges. We are totally frustrated. So finally, finding no way out, we have knocked the doors of the judiciary for justice.”
