Prohibitory order issued around ARO office ahead of Silchar Municipal Corporation Election

way2barak, September 7: –In view of the ongoing process of receipt of nomination papers from contesting candidates for the ensuing Silchar Municipal Corporation Election, 2026, and anticipating a large gathering of people on the final day of submission of nominations, the District Magistrate, Cachar, Rahul Kumar Gupta, has promulgated a prohibitory order under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in the interest of maintaining public peace, security and tranquillity.

As per the order, the last date for submission of nomination papers has been fixed for September 11, 2026. Considering the likelihood of a large gathering of candidates, supporters and other persons at the office of the Assistant Returning Officer, the District Magistrate has deemed it necessary to impose certain restrictions around the designated premises at Government Boys’ Higher Secondary School, Sadarghat Road, Silchar.

Accordingly, street vendors have been prohibited from operating within a radius of 100 metres of the Assistant Returning Officer’s Office on September 10 and 11, 2026 between 10:00 AM and 5:00 PM. The order also prohibits the assembly of five or more persons within the 100-metre radius of the Assistant Returning Officer’s Office during the said period without prior permission from the District Magistrate.

The restrictions have been imposed as a preventive measure to ensure the smooth conduct of the nomination process and to maintain public order, peace and tranquillity in and around the designated area. The order, however, shall not apply to police and Army personnel, Magistrates and Judicial Officers on duty and persons engaged in Government works including election-related duties.

In view of the exigency of the situation, the prohibitory order has been issued ex-parte under Section 163 of the Bharatiya Nagarik Suraksha Sanhita and shall come into force with immediate effect.

The District Magistrate has further cautioned that any violation of the prohibitory order shall be punishable under Section 223 of the Bharatiya Nyaya Sanhita.
