SI sentenced to 7 years imprisonment for bribery

way2barak, Nov 22: Today, on 22nd November 2023, the Hon’ble Court of Special Judge, Assam convicted Bhagyeswar Hazarika for offence of bribery. He has been sentenced to undergo 3 years rigorous imprisonment and fine of Rs. 3,000/-, in default rigorous imprisonment of 1 month u/s 7 of the PC Act, 1988. He has also been sentenced to 4 years rigorous imprisonment and fine of Rs. 5,000/- in default rigorous imprisonment of 2 months u/s 13(2) of the PC Act. Both the sentences will run concurrently.
A complaint was received on 28.03.2018 at this Directorate of Vigilance & Anti-Corruption, Assam, alleging that SI(UB) Bhagyeswar Hazarika, posted at Bakalia Police Station, Dist-Karbi Anglong, demanded Rs. 3,000/- (Rupees three thousand only) as bribe from the complainant for releasing his bike.
Unwilling to pay the bribe, the complainant had approached this Directorate for taking necessary legal action against the above-mentioned public servant.
Accordingly, a trap was laid on 28/03/2018 by a team from the Directorate of Vigilance and Anti-Corruption, Assam, in Bakalia Police Station, Dist- Karbi Anglong. SI(UB) Bhagyeswar Hazarika was caught red handed in presence of independent witnesses immediately after he accepted Rs. 3,000/- (three thousand only) as demanded bribe from the complainant. The tainted bribe money was recovered from his possession and was seized accordingly in presence of independent witnesses.
This refers to ACB PS Case No. 03/2018, U/S 7/13(1)(d)/13(2) of the Prevention of Corruption Act, 1988. The case was charge sheeted on 29/3/2019.
