Govt. of Assam fixes maximum annual fees for private schools & colleges

Provision of applying for a probable exemption from the prescribed structure- serious loophole

Dec. 4: Finally, Assam government has come up with a stricture specifying maximum annual fees which a private school and college can charge from the students in the state. The cap on fee structure by the state government was a welcome move which was contemplated by the parents and guardians since long whose wards are studying in private institutions in Assam.

On the basis of the Assam Non-Government Educational Institutions (Regulation of Fees) Act, 2018 and the Assam Non-government Educational Institutions (Regulation of Fees) Rules 2020, the Commissioner and Secretary to the Government of Assam Secondary Education Department has issued a notification as per which, the fee structure of pre-primary to Class XII (private institutions) was fixed.

The total fees means all types of fees, collected by whatever name like admission fees, tuition fee, building or infrastructure development fee, sports/ cultural fee etc. but excluding the transportation fees,” the official notification read.

However, many regarded that the notification has got serious loopholes. It was stated that, “The Non-Government Educational Institutions, charging an annual fee equal or below the above mentioned amount, have to apply for an exemption certificate from the Fee Regulatory Committee and the Non-Government Educational Institutions, who intend to charge fee above than the fee prescribed by Government, have to apply for fee fixation before the Fee Regulation Committee with proper justification.”

Some parents have expressed the view that many schools are mulling using the provision of applying for a probable exemption from the prescribed structure. Since it is clearly mentioned in the advertisement that institutions intending to charge fees above the prescribed fee have to apply for fee fixation, the same will be done accordingly by all institutions who wish to continue collecting high fees.

The notification further stated, “All the concerning educational institutions are requested to submit their applications online before January 15, 2021 for fixation of their fees for the academic year of 2021-22 on the website www.feeregulatoryassam.com.
