DHE Assam suspends Prinicipal in-charge & Senior Office Asstt of RK Nagar College as per High Court order

April 23: As per direction of Gauhati High court on 5 April, 2021, Director of Higher Education (DHE), Assam issued suspension order of Principal in-charge of Ramkrishna Nagar College- Mohitosh Chakraborty and Senior Office Assistant- Gouri Shankar Biswas of the same College.

In a speaking order issued by the DHE, Assam, it was stated that the High Court has passed an order dated 05-04-2021 in W.P.(C) No. 458/2017 filed by Dr. Mala Sharma-Vs-the State of Assam and others as “We have taken note of that because of the disruptive activities on the part of the In-Charge Principal and the respondent No.6, Shri Gouri Shandar Biswas, (UDA), the process for selection of the regular Principal is still continuing in his post. The Director shall inform the court as indicated above on the next date fixed.”

The Directorate of Higher Education has issued a letter vide No. DHEJCE/AC/Permission/116/2017/45, dated 21-02-2018, giving permission of advertisement for filling up the post of the Principal of the college, to the President of R.K. Nagar College along with other colleges. “It was, however, noticed that Sri Mohitosh Chakraborty, Principal in-Charge of the college was unwilling to record the minutes of the meeting regarding the constitution of the Selection Committee for appointment of a regular Principal of the college. (On the contrary it is reported that Principal In-Charge (Sri Mohitosh Chakraborty) was instigating some people to stand against the opinion of the house,” stated the DHE.

Further, it was reported that some important minutes of the meeting were not recorded by Sri Mohitosh Chakraborty, Principal In-Charge of R.K. Nagar College at that stage. “Shri Gouri Shankar Biswas, Senior Assistant of the college who is a non-teaching staff member of the college also is reported to have created a chaotic situation and threatened to physically assault the President of the Governing Body.”

“In view of the above fact and as per Hon’ble High Court order dated 05-04-2021, Sri Mohitosh Chakraborty, Principal in-Charge and Shri Gouri Shankar Biswas, Senior Assistant of R.K. Nagar College, Karimganj, is hereby placed under suspension with immediate effect. They are allowed to draw subsistence allowance as per rule. The suspended incumbents shall not leave the headquarter without having prior permission from the appointing authority,” stated the speaking order of the DHE, Assam.
