Assam becomes India’s first State to enact Tenancy Act

Aug. 13: In a significant move, Assam became India’s first State to enact Assam Tenancy Act 2021. This Act aims to protect the rights of Landlords and Tenants and will establish a regulatory authority for providing a speedy resolution of disputes. Taking to his twitter handle on Friday, this was informed by Chief Minister Dr Himanta Biswa Sarma.

Highlights of the Assam Tenancy Act 2021:

  • The Act will repeal the Assam Urban Areas Rent Control Act 1972, and to establish a rent authority to regulate renting of premises and to protect the interests of landlords & tenants.
  • The Assam Tenancy Act 2021 will provide a speedy adjudication mechanism for the resolution of related disputes and matters.
  • There will be no artificial cap in fixing the rent of a premise. The rent of a I building will be market-driven and will be determined by mutual agreement between tenants and landlords.
  • The Act will simplify and make faster the procedure of redressal of disputes between landlords & tenants through the establishment of rent authority, a rent court, and rent appellate at the district level.
  • The Act specifies the duties and obligations of landlords and tenants regarding maintenance and upkeep of the premises, eliminating any ambiguity in this regard.
