Supreme Court to hear today plea against Ranjan Gogoi’s appointment as CJI

২৬ সেপ্টেম্বর : আর হাতেগোনা মাত্র কয়েকদিন বাকি। সুপ্রিম কোর্টের মুখ্য বিচারপতি পদে রঞ্জন গগৈর দায়িত্ব নেওয়ার দিনক্ষণ পাকা। আগামী ৩ অক্টোবর তিনি মুখ্য বিচারপতি পদে শপথ নেবেন। কিন্তু তার আগে সুপ্রিম কোর্টের প্রধান বিচারপতি পদে তাঁর মনোনয়নকে চ্যালেঞ্জ জানিয়ে আবেদন দাখিল করা হলো। দেশের সর্বোচ্চ আদালত এই আবেদনের শুনানি গ্রহণে সম্মতিও দিয়েছে। প্রধান বিচারপতি দীপক মিশ্র, বিচারপতি এ এম খানবিলকর ও বিচারপতি ডি ওয়াই চন্দ্রচূড়ের বিশেষ বেঞ্চ এ বিষয়ে বুধবার জরুরি ভিত্তিতে শুনানি গ্রহণ করবে বলে জানিয়েছে।

প্রসঙ্গত, চলতি বছরেরই ১২ জানুয়ারি প্রধান বিচারপতি দীপক মিশ্রের বিরুদ্ধে পক্ষপাত সহ একাধিক অনিয়মের অভিযোগ এনে বিদ্রোহ ঘোষণা করেছিলেন রঞ্জন গগৈ সহ সুপ্রিম কোর্টের চার আইনজীবী। এবার দিল্লির খ্যাতনামা আইনজীবী সত্যবীর শর্মা সুপ্রিম কোর্টের প্রধান বিচারপতি পদে রঞ্জন গগৈর নিযুক্তিকে চ্যালেঞ্জ জানিয়ে একটি আবেদন দাখিল করেন। এতে তিনি অভিযোগ করেন, দেশের বিচার ব্যবস্থায় অন্তর্ঘাতের চেষ্টা করেছেন গগৈ। তিনি প্রধান বিচারপতি পদে রঞ্জন গগৈর নিযুক্তির এই সিদ্ধান্তকে অসাংবিধানিক বলেও দাবি করেন।

তিনি বলেছেন, দেশে এই প্রথমবার বিচার ব্যবস্থার স্বচ্ছতা নিয়ে প্রশ্ন তুলে এবং প্রকাশ্যে প্রধান বিচারপতির প্রতি অনাস্থা ব্যক্ত করে চিঠি লেখা হয়েছে। আইনজীবী তাঁর আবেদনে বলেছেন, রঞ্জন গগৈ সহ অন্য অভিযোগকারীদের বিরুদ্ধে কোনও ব্যবস্থা গ্রহণ না করে গগৈকে দেশের প্রধান বিচারপতি পদে বহাল করা মোটেই যথাযথ সিদ্ধান্ত নয়।

মঙ্গলবার প্রধান বিচারপতি দীপক শর্মার বেঞ্চে এই আবেদন দায়ের করেন সত্যবীর শর্মার আইনজীবী আরপি লুথরা। এদিকে প্রধান বিচারপতি পদে রঞ্জন গগৈর নিয়োগপত্রে ইতিমধ্যেই স্বাক্ষর করেছেন রাষ্ট্রপতি। আগামী ৩ অক্টোবর তাঁর শপথ নেওয়ার কথা রয়েছে।

September 26: Petitioner advocate RP Luthra has held Justice Ranjan Gogoi “guilty” of “committing judicial impropriety and judicial misconduct” by talking to the media on judicial proceedings at the Supreme Court. The petitioners have made Union of India and Chief Justice of India (CJI) Dipak Misra as respondents for “his illegal and anti-institutional act.”

On Tuesday, the Supreme Court agreed to hear the plea challenging the appointment of Justice Ranjan Gogoi as the next Chief Justice of India. A bench of Chief Justice Dipak Misra and Justice A M Khanwilkar and D Y Chandrachud asked Luthra to file the mentioning memo before the court master. The apex court bench will hear the case today. In their plea, Luthra along with petitioner advocate Satyaveer Sharma said they are looking for a judgment on the question of law. The advocates have based their arguments on the contents of the press conference of January 12, called by four senior most judges of apex court — Justices Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph. The plea said the petitioners were also relying on an undated letter addressed to Chief Justice of India and circulated by the four apex court judges.

The petition said that act of Respondent 1 and Respondent 2 “is illegal and unconstitutional and also against the canons of law because the appointment on highest post of judiciary has been awarded to a person who is guilty of committing judicial impropriety and judicial misconduct”. The plea also sought quashing of the order of appointment of Justice Ranjan Gogoi as the Chief Justice of India with effect from October 3.

It needs mention here that President Ram Nath Kovind appointed Justice Gogoi as the 46th Chief Justice of India on September 3. Justice Gogoi is scheduled to take the oath of office and secrecy on October 3 after incumbent Chief Justice Dipak Misra retires. With this petition in question, the eyes of the nation will be on the bench of the apex court which will hear it today. If the plea of Luthra & Sharma is accepted by the bench, then it would be a perfect example of “There’s many a slip between the cup and the lip” for Justice Ranjan Gogoi.
