Silchar CJM court sentences 1 Rohingiya and 3 Bangladeshi illegal migrants

July 10: The Court of Chief Judicial Magistrate (CJM), Silchar on 10 July, 2019 passed an order of conviction of four illegal migrants. Out of the 4 illegal migrants, one Rohingya migrant and three illegal migrants from Bangladesh were convicted by a Chief Judicial Magistrate’s court at Silchar for illegally entering into restricted areas of Sonabarighat in Cachar, Assam.

On being tipped off, a police team under Silchar P.S.conducted a raid and searched the house of one Siribul Islam Barlaskar situated at Sonabarighat on 11 February, 2019 and found 8 suspected illegal migrants over there. On interrogation, they failed to produce any valid document in support of Indian Citizenship before the police. As such, the police team of Silchar P.S. arrested all the aforesaid illegal migrants. An FIR in this regard was filed by Head Constable of Silchar P.S. Anjan Kumar Roy against the said illegal migrants.

Thereafter, police registered a case vide Silchar P.S.Case No.485 of 2019 u/s 14A and 14C of the Foreigners Act,1946. After completion of investigation, police submitted charge sheet on 30 April, 2019 against the accused Siribul Islam Laskar, Jahid Ahmed, Amir Khan, Halima Khatun,Dilbar Begum. The others were juvenile.

At the time of consideration of charge of G. R. Case No.789 of 2019 in presence of Additional Public Prosecutor Dharmananda Deb, four accused persons viz. Jahid Ahmed, Amir Khan, Halima Khatun, and one Rohingiya Dilbar Begum along with their lawyer admitted their guilt. In the backdrop of their confession, the CJM Mishbahul Hassan Ansari sentenced them to 2-year of imprisonment and fine of Rs.10,000 (if unable to pay fine, another two months of simple imprisonment) under Section 14A of the Foreigners Act,1946.

Speaking to way2barak, Additional Public Prosecutor of CJM court Dharmananda Deb said, “This case will proceed under Section 14A and 14C of the Foreigners Act,1946 against the abettor of offence, Siribul Islam Barlaskar as he has not pleaded his guilt before the CJM court today.”
