NRC: NELACC to file PIL in Supreme Court

২১ সেপ্টেম্বর : নাগরিকপঞ্জির চূড়ান্ত খসড়ায় নাম না থাকা এক ব্যক্তির ১৯৭১ সালের বেশ কয়েক বছর আগের সিটিজেনশিপ সার্টিফিকেট রয়েছে। কিন্তু সরকারের দেওয়া এই অন্যতম নথিটি বাতিল ৫টি নথির তালিকায় পড়ে যাওয়ায় দ্বিতীয়বার আবেদন জানাতে তিনি সমস্যায় পড়ে গেছেন।

নাগরিকপঞ্জিতে নাম অন্তর্ভুক্তির ক্ষেত্রে এই ডামাডোল পরিস্থিতির মধ্যে এক বৈঠক করে নর্থ ইস্ট লিঙ্গুইস্টিক অ্যান্ড কো-অর্ডিনেশন কমিটি অর্থাৎ নেলেক জানিয়ে দিয়েছে, পাঁচটি নথি বাতিল সংক্রান্ত সুপ্রিম কোর্টের নির্দেশের বিরুদ্ধে সর্বোচ্চ আদালতেই জনস্বার্থ সংক্রান্ত মামলা দায়ের করতে চলেছে সংগঠন। এ ব্যাপারে আইনজীবী শান্তনু নায়েকের নেতৃত্বে পাঁচ সদস্যের একটি কমিটিও গঠন করা হয়। বৈঠকের সিদ্ধান্ত অনুযায়ী বলা হয়েছে, জনস্বার্থ মামলা করার ব্যাপারে এই কমিটি যাবতীয় তথ্য সংগ্রহ করে প্রস্তুতি নেবে। এক্ষেত্রে সম্পূর্ণ ব্যক্তিগত উদ্যোগেই বিভিন্ন ভাষাগোষ্ঠীর পাঁচজন ব্যক্তি জনস্বার্থ মামলা করার ব্যাপারে মূল উদ্যোগ নেবেন।

এদিকে এনআরসি সমন্বয়ক প্রতীক হাজেলার এসওপির ভিত্তিতে সুপ্রিম কোর্ট পাঁচটি নথি বাতিলের যে নির্দেশ জারি করেছে, তা নিয়ে এনআরসি ছুটদের মধ্যে নতুন করে আতঙ্ক শুরু হয়েছে। এ সংক্রান্ত বিষয়ে বিস্তারিত আলোচনার জন্য আগামী ২৭ সেপ্টম্বর দুপুর দুটোয় শিলচর গান্ধীভবনে বরাকভিত্তিক এক নাগরিক সভা করার সিদ্ধান্ত নিয়েছে নেলেক। এই নাগরিক সভায় বরাক উপত্যকার রাজনৈতিক এবং অরাজনৈতিক সংগঠনের প্রতিনিধিদের উপস্থিত থাকতে অনুরোধ জানানো হয়েছে।

অন্যদিকে এ নিয়ে নেলেকের পক্ষ থেকে সুপ্রিম কোর্ট নির্দেশিত ১০টি নথি যাদের রয়েছে, তাদের নির্দিষ্ট সেবাকেন্দ্রে গিয়ে আবেদনপত্র জমা দেওয়ার আহ্বান জানানো হয়েছে। তবে যাদের কাছে শুধুমাত্র বাতিল পাঁচটি নথি রয়েছে, তাদের আগামী ২৩ অক্টোবর পর্যন্ত অপেক্ষা করার অনুরোধ জানানো হয়েছে। সংগঠনের পক্ষ থেকে বলা হয়, ২৩ অক্টোবরের পরও আবেদন জানানোর জন্য আরও দু’মাস সময় যাতে দেওয়া হয় সে ব্যাপারে নেলেক এর পক্ষ থেকে সুপ্রিম কোর্টে আর্জি জানানো হবে।

বৃহস্পতিবার আয়োজিত এই সভায় নেলেকের পক্ষে উপস্থিত ছিলেন কিরীট ভূষণ পুরকায়স্থ, বিভাস দেব, শান্তনু নায়েক, কঙ্কন নারায়ণ শিকদার প্রমুখ।

September 21: A person whose name was not included in the final draft of NRC inspite of submitting pre-1971 Citizenship Certificate is now in doldrums. It is so because the five documents included in the so far reject list also includes the citizenship certificate. He is now unable to produce any other document for claiming his rightful position in the final NRC.

It is in this situation of crisis and confusion that a meeting was organised by North East Linguistic & Coordination Committee (NELACC). The Coordination Committee held a threadbare discussion to find ways and means to mitigate the problems of those whose names have not been included in the final draft of NRC. The members of NELACC have unanimously decided to file a Public Interest Litigation (PIL) in the Supreme Court. In this regard a 5 member committee was formed with Advocate Santanu Naik as its head. The house deliberated that this committee will collect all necessary and relevant information which will be useful regarding filing this PIL. Further, 5 persons belonging to different linguistic communities will take the actual initiative regarding the PIL.

Meanwhile tension is prevailing in the hearts of those who names were not included in the final draft. The apex court has accepted the proposal of NRC Coordinator Prateek Hajela and set aside 5 documents which were initially recognized as valid for proving one’s citizenship. In this regard, NELACC has convened a Barak based citizen’s meet at Gandhi Bhawan on 27 September at 2 in the afternoon. All political and non-political organizations were invited by NELACC to this important meeting.

Speaking during the meeting, Advocate Santanu Naik said, “ It is high time for each and every resident of Assam, especially that of Barak Valley to rise above Party Politics and to be united for fighting the long drawn battle initiated by some of the Organisations of Assam. The Order, dated- 19/09/18 passed by the Supreme Court in regard to NRC is sure to throw lakhs of bonafide and genuine Indian Citizens as Stateless and non-residents and so NELECC in its Meeting, dated-20/09/18 has finally decided to file a PIL before the Supreme Court in this month itself. At the same time NELECC has also decided to organise an Open Meeting on 27/09/18 at Gandhi Bhawan, Silchar from 2.00 P.M. onwards.”

NELACC has also suggested that those who have any of the 10 listed documents should go to the specified centres to file their claims. However, those who are in the possession of the 5 ‘invalid’ documents were advised to wait till 23 October. The members present said that they would further appeal before the Supreme Court to provide another 2 months time after 23 September for filing of claims and objections.

The meeting organized on Thursday was attended by Kiriti Bhusan Purkayastha, Bivash Deb, Santanu Naik, Kankan Narayan Sikdar among others.
