Crackers can be bursted in Diwali from 8 PM to 10 PM: Supreme Court

২৩ অক্টোবর : উতসব অনুষ্ঠানে যখন তখন বাজি পোড়ানোর ক্ষেত্রে কঠোর মনোভাব পোষণ করেছে সুপ্রিম কোর্ট। দেশের সর্বোচ্চ আদালত জানিয়ে দিয়েছে, দেওয়ালিতে বাজি পোড়ানো যাবে শুধুমাত্র রাত আটটা থেকে ১০টার মধ্যে।

বায়ুদূষণ রোধে দেশজুড়ে বাজি পটকার উৎপাদন ও বিক্রির ক্ষেত্রে নিষেধাজ্ঞার প্রেক্ষিতে এক আবেদনে আজ সুপ্রিম কোর্ট এক রায় দিয়েছে। এই রায়ে সুপ্রিম কোর্ট কিছু শর্তসাপেক্ষে বাজি পটকার বিক্রি ও এর ব্যবহারের ক্ষেত্রে অনুমতি দিয়েছে। এর আগে অবশ্য সুপ্রিম কোর্ট বাজিপটকার ওপর পুরোপুরি নিষেধাজ্ঞার বিষয়টি খারিজ করে দেয়। এ ব্যাপারে সর্বোচ্চ আদালত বলেছে, জীবনযাত্রায় সব কিছুরই প্রয়োজন রয়েছে। এমনকি বাজিপটকা উৎপাদনকারীদের জীবিকার প্রশ্নে তাদের মৌলিক অধিকারের বিষয়টিও।

বিচারপতি একে সিক্রি এবং বিচারপতি অশোক ভূষণের বেঞ্চ গত ২৮ আগস্ট এ বিষয়ে শুনানির সময় রায়দান স্থগিত রেখেছিল, যা আজই ঘোষণা করা হয়েছে। এই রায়ে আরও বলা হয়েছে যে, কম শব্দ ও ক্ষমতার বাজি তৈরির ক্ষেত্রে উৎপাদনকারীদের অনুমতি রয়েছে। তবে বাজি বিক্রি করতে পারবেন শুধুমাত্র যাদের লাইসেন্স রয়েছে তারাই। অনলাইনে কেউ বাজি বিক্রি করতে পারবেন না। কেউ তা করলে সেটি হবে আদালতের নির্দেশ অবমাননা। এতে আরও বলা হয়েছে, সরকারের উচিত এ ব্যাপারে আরও বেশি করে জনসচেতনতা গড়ে তোলা।

এই রায়ে সুপ্রিম কোর্ট স্পষ্ট বলেছে সব ধরনের উৎসব এবং বিবাহের মতো অনুষ্ঠানের সময় বাজি পটকার উৎপাদন, বিক্রি এবং এর ব্যবহার করা যাবে। অবশ্য পটকা ফাটানোর ক্ষেত্রে সুপ্রিম কোর্ট সময়সীমা বেঁধে দিয়েছে। দেওয়ালি উৎসবে পটকা ফাটানোর সময় রাত ৮টা থেকে ১০টার মধ্যে। বড়দিন বা নিউ ইয়ার এর অনুষ্ঠান হলে বাজি ফাটানোর সময় রাত ১১টা ৫৫ মিনিট থেকে সাড়ে ১২টা পর্যন্ত।

October 23: The Supreme Court has pronounced its verdict today on a plea seeking a ban on manufacture and sale of firecrackers across the country to curb air pollution. In its verdict, the apex court has allowed sale and use of firecrackers with conditions.

Supreme Court had earlier opposed complete ban on firecrackers and said there is a need to account all aspects including the fundamental right of livelihood of firecrackers manufacturers. A bench of Justices AK Sikri and Ashok Bhushan which had reserved its verdict on August 28 has pronounced its judgement on this crucial issue a little ago.

The verdict issued today further stipulated that crackers with reduced emission would only be permitted to be manufactured. Sale of crackers should take place only through license holders. No e-commerce can sell crackers and if they do so, then they will be hauled for contempt of court. It further directed that the government should undertake extensive public awareness on this issue.

The verdict of the Supreme Court on manufacture, sale and use of firecrackers shall apply to all festivals and functions like marriages.As regards time of bursting crackers, the apex court directed that fire crackers can be bursted during the festival of Diwali from 8 PM to 10 PM.On Christmas and New Year, the timings was set from 11:55 PM to 12:30 AM. Supreme Court directs Central Pollution Control Board to monitor air quality 7 days before and 7 days after Diwali. It further stated that only designated community areas in Delhi-NCR identified by Central Pollution Control Board will be allowed for bursting.

Buoyed by the ban on firecracker sale in the National Capital Region last year, a petition has called for the countrywide ban on manufacture, sale and possession of firecrackers, citing their ill effects on the environment and public health. The Centre has opposed complete ban on sale of crackers during Diwali across the country. It has suggested that certain conditions could be imposed on the manufacture and sale of high-decibel firecrackers. The top court had earlier expressed concern over the growing respiratory problems among children due to air pollution.
