১৯ সেেপ্টেম্বর: গুরুত্বপূর্ণ পাঁচ নথিকে বাদের খাতায় রেখে খসড়া-ছুটদের পুনঃ আবেদনের যে রায় দিয়েছে সুপ্রিম কোর্ট, তাতে বরাক উপত্যকায় সমালোচনার ঝড় উঠেছে। কেউ প্রকাশ্যে, কেউ নাম প্রকাশ না করে সুপ্রিম কোর্টের ভূমিকা নিয়ে প্রশ্ন তুলেছেন। ক্ষোভ ব্যক্ত করেছেন রাজ্য ও কেন্দ্রীয় সরকারের দায়সারা মনোভাবেও।

উত্তর করিমগঞ্জের কংগ্রেস বিধায়ক কমলাক্ষ দে পুরকায়স্থ way2barak.com- কে দেওয়া এক একান্ত সাক্ষাতকারে বলেন, উভয় সরকার গোপন বোঝাবুঝির ভিত্তিতেই প্রতীক হাজেলা পাঁচ নথিকে বাদ দেওয়ার প্রস্তাব দিয়েছেন। বাঙালিদের হেনস্তার জন্য পরিকল্পনামত তা করা হয়েছে। নইলে এক এনআরসি প্রক্রিয়ায় ২কোটি ৯৮ লক্ষ মানুষের জন্য এক আইন, আর ৪০ লক্ষ খসড়াছুটের জন্য আরেক আইন হতে পারে না।

এখন উপায়? কমলাক্ষবাবুর কথায়, সুপ্রিম কোর্টের তত্ত্বাবধানে যেহেতু পুরো বিষয়টি চলছে, ফলে আইনি লড়াইয়েই এর সমাধান খুঁজতে হবে। সুপ্রিম কোর্টের বুধবারের রায়ের প্রেক্ষিতে আরেকটা রিট আবেদন জানানোর সিদ্ধান্ত নিয়েছেন উত্তর করিমগঞ্জের বিধায়ক। পাশাপাশি তিনি বিস্মিত, কোনও নথি সংসদীয়, প্রশাসনিক বা রাজ্যের বিচার বিভাগকে প্রদান করা চলবে না বলে সর্বোচ্চ আদালতের নির্দেশে। তাঁর কথায়, এ বড় ভয়ঙ্কর কথা। জনপ্রতিনিধিদের না জানানোটাকে বিপজ্জনক বলেও মন্তব্য করেন তিনি। এইসব বিষয়েও তাঁর আইনজীবীর সঙ্গে কথা চলছে।কমলাক্ষবাবু বলেছেন, এই নির্দেশ গণতন্ত্রের উপর আঘাত।

এ দিকে, নাগরিক অধিকার রক্ষা সমন্বয় কমিটিও তীব্র ক্ষোভ প্রকাশ করে বলে, যে দশ নথির ভিত্তিতে পুনঃ আবেদনের সুযোগ দেওয়া হয়েছে, তার অধিকাংশেরই এখন অস্তিত্বহীন। ফলে ৪০ লক্ষ বাদ পড়ার সকলকে বাইরে রাখারই ষড়যন্ত্র চলছে।

September 19: A wave of criticisms have started to pour in from various nook and corner of Barak Valley on the matter related to disallowing 5 documents to prove one’s citizenship by the Supreme Court of India. Some are openly while others are clandestinely raising questions on the role of the Supreme Court. People also criticized the attitude of indifference exhibited by both the centre and the states on this issue.

However, Kamalakhya Dey Purkayastha, MLA South Karimganj while speaking to way2barak over telephone from Delhi has termed the entire episode to be very unfortunate. He in an assertive voice has argued that Hajela’s affidavit in the Supreme Court proposing to delete 5 out of the 10 documents earmarked to proving one’s citizenship is a bi-product of a larger conspiracy between the centre and the state. This he believes was done by Hajela on the behest of a political will to unnecessarily harass the Bengalis. He categorically stated that applying two different sets of principles in determining citizenship has got no logic behind this. Inclusion of  names of 2 crore 98 thousand people on the basis of 15 type of documents, whereas inclusion of rest 40 lakh on the basis 10 documents is definitely a discriminatory one, which defies the very perception of right to equality.

So what’s the way out? Kamalakhya Dey Purkayastha opined that as the entire process of NRC is held under the supervision of the Supreme Court, so the solution would lie in a legal battle. On the backdrop of the verdict given by the apex court on Wednesday, MLA South Karimganj has decided to file another writ petition. He also expressed surprise to the fact that the court has directed not to share any information pertaining to the ongoing exercise of updation of the NRC with any Executive, Legislative or Judicial Authority of the State. He said that this seems to be a very dangerous provision. He feels that to hide anything from the purview of the public representatives is a risky matter. He was consulting all these and various other legal angles with his advocate. He argued that such types of decisions are an attack on the democratic values.

Meanwhile, the Citizens Right Protection Joint Committee have expressed deep resentment and said that those 10 documents on the basis of which people were asked to proof their citizenship are largely non-existent. As such, this is a big conspiracy to keep 40 lakh people outside the arena of NRC, whose names were not enlisted in the final draft.
