কাশ্মীরে সম্পত্তি ক্রয়বিক্রয়, জানুয়ারিতে সুপ্রিম কোর্টে শুনানিSale & Purchase of property in Kashmir: Supreme Court hearing deferre
১৯৫৪ সালে রাষ্ট্রপতির নির্দেশে ভারতের সংবিধানে যুক্ত হয়েছিল এই ৩৫ (ক) ধারা। তাতে জম্মু-কাশ্মীরের বাসিন্দাদের কিছু বিশেষ অধিকার ও সুযোগ-সুবিধের কথা বলা হয়েছে। বহির্রাজ্যের কেউ কাশ্মীরে গিয়ে সম্পত্তি কিনতে পারবে না, ওই বিশেষ অধিকারেরই আওতাভুক্ত। এমনকী, বহির্রাজ্যের কারও সঙ্গে বিয়ে হলে মেয়েরা পৈতৃক সম্পত্তির অধিকার থেকেও বঞ্চিত হন।
The provisions of Article 35-A bars Indian citizens, other than those who are permanent residents of J&K, from seeking employment, settling in the state, acquiring immovable properties or undertaking any trade or business if the state makes any law to that effect and it cannot be challenged before any court. Earlier in the first week of August, the apex court had deferred the hearing in the matter to the last week of August after both the Centre and Centre-ruled J&K administration sought an adjournment of proceedings, citing ongoing preparations for local body polls.
On Friday, the court deferred the hearing of the case to the second week of January after the Jammu and Kashmir government said it plans to hold Panchayat elections in the state between September and December and a debate on the Article 35A could trigger law and order problems. Already, there have been several protests in the state against the Supreme Court’s move to hear the challenges to the law.
The petitioner, however, asserted their stand, saying the law has excluded many from getting into professional colleges despite living in the state for 60 years. The lawyer for Charu Wali Khanna, one of the petitioners, said that the law prevented her from buying property because she married a non-Kashmiri.
After hearing out the arguments, Justice AM Khanwilkar observed: “When the state says there could be a law and order problem beyond their control how can we hear the case?” Chief Justice Dipak Misra too questioned petitioners: “Article 35A came in 1954 and you challenge it after 60 years?”
