NRC: Next hearing on 1 November

২৩ অক্টোবরঃ ৪০ লক্ষ মানুষের অপেক্ষা আর শেষ হচ্ছে না। খসড়াছুটদের এনআরসি-তে নাম তোলার জন্য দাবি জানানোর প্রক্রিয়া সু্প্রিম কোর্ট আবারও ঝুলিয়ে রাখল। মঙ্গলবার ডিভিশন বেঞ্চ রায় দিয়েছে, পরবর্তী শুনানি হবে ১ নভেম্বর। এর আগে এনআরসি-র রাজ্য কো-অর্ডিনেটর প্রতীক হাজেলা এই মামলার সংশ্লিষ্ট সব পক্ষকে পাওয়ার-পয়েন্ট প্রেজেন্টেশনের সাহায্যে বুঝিয়ে বলবেন, কেন তিনি মনে করেন, পুনঃআবেদনে ৫ নথি বিচার্য হওয়া উচিত নয়। সে সময় সলিসিটর জেনারেল তুষার মেহতা বা তাঁর এক প্রতিনিধিকে উপস্থিত থাকতে বলা হয়েছে।

প্রধান বিচারপতি রঞ্জন গগৈ ও বিচারপরি রোহিন্টন ফলি নরিমান এ দিন হাজেলাকে এ সংক্রান্ত নির্দেশ দেন। পাশাপাশি কেন্দ্রীয় সরকার, রাজ্য সরকার ও সংশ্লিষ্ট পক্ষগুলিকে আগামী ৩০ অক্টোবরের মধ্যে হাজেলার প্রস্তাবে আপত্তি থাকলে তা সর্বোচ্চ আদালতকে জানাতে বলেছেন।  সংশ্লিষ্ট পক্ষ কারা, তাও রায়ে স্পষ্ট করে দেন বিচারপতিদ্বয়। কেন্দ্র, রাজ্য ছাড়াও তাদের মধ্যে রয়েছে অল আসাম স্টুডেন্টস ইউনিয়ন (আসু) , অল আসাম মাইনরিটি স্টুডেন্টস ইউনিয়ন (আমসু), জমিয়ত উলেমা-ই-হিন্দ, আসাম পাবলিক ওয়ার্কস, আসাম সম্মিলিত মহাসংঘ, ন্যাশনাল ডেমোক্র্যাটিক ফ্রন্ট অব বড়োল্যান্ড (প্রোগ্রেসিভ), ইন্ডিজেনাস ট্রাইবাল পিপলস ফেডারেশন এবং জয়েন্ট অ্যাকশন কমিটি ফর বেঙ্গলি রিফ্যুজিস।

বিচারপতি গগৈ ও বিচারপতি নরিমান এ দিন তাঁদের রায়ে বলেন, প্রতীক হাজেলা আদালতের কাছে দু-দিন দুটি রিপোর্ট পেশ করেছেন। প্রথমটি ১৯ সেপ্টেম্বর, মুখবন্ধ খামে। অন্যটি ৪ অক্টোবর। প্রথমটি গোপনই থাকবে। দ্বিতীয়টির কথা এর আগেই রায়ে জানিয়ে দেওয়া হয়েছিল। তাতে হাজেলা বলেছিলেন, কেন ৫ নথিকে আর বিচার্য নয়। ওই বক্তব্যই এখন পাওয়ার পয়েন্টে সবকটি পক্ষকে দেখানো হবে।

The fate of 40 lakh plus people of Assam seems to be overcast by strings of delay. It appears to be a never ending wait for them. On Tuesday, Supreme Court once again reserved its judgement on the issue of claims to be made by those whose names were excluded from the final draft of NRC published on 30 June. The division bench comprising of Chief Justice Ranjan Gogoi and Justice Rohinton F Nariman has posted the matter for hearing on 1 November.

The apex court directed that NRC State Coordinator Prateek Hajela will have to give a power point presentation before the lawyers of all the parties wherein he should explain why the 5 documents should not be reconsidered for filing claims by those whose names were left out from the final draft NRC. The power point session will also be attended by Attorney General K.K. Venugopal and Solicitor General Tushar Mehta. The bench also stated that, if after watching the power point presentation, the lawyers have any new arguments, then they will have to inform the same to the apex court by 30 October.

Meanwhile, it has been learnt that NRC State Coordinator Prateek Hajela will make the power point presentation as per the direction of the Supreme Court on 26 October at Assam House.
